The Guarantor for the protection of personal data has decided to temporarily limit the processing of Italian users’ data by OpenAI, a US-based company that manages an artificial intelligence platform. Furthermore, the Guarantor has opened an investigation due to the lack of information provided to users and the absence of a legal basis for the collection and storage of personal data. The measure was taken following a data loss suffered by ChatGPT, OpenAI’s artificial intelligence software that simulates and processes human conversations. The Guarantor also found that the information provided by ChatGPT does not always correspond to the real data, leading to inaccurate processing of personal data. Finally, the absence of a filter to verify users’ age exposes minors to inadequate responses. OpenAI, which has no headquarters in the European Union, must communicate the measures taken within 20 days in compliance with the Guarantor’s request, under penalty of a fine of up to 20 million euros or up to 4% of the annual global turnover.
